1. Purpose

These Terms and Conditions of Use (“TCU”) define how Quztom provides professionals in the plumbing, heating, and air conditioning sectors with its services for creating and managing technical documents, including the addition of photos, parts, equipment, and technical data.
The use of Quztom is free of charge, and the website displays advertisements from third-party advertisers to fund its services.

2. Access to the Services

Access without Registration: To use the Services, the User enters their email address and receives a secret code sent by email to authenticate their session.
Availability: Quztom strives to ensure maximum availability of the Services, except in cases of maintenance or force majeure. Quztom reserves the right to interrupt, suspend, or modify all or part of the Services at any time to perform maintenance or updates.

3. Registration and Account

Account Creation: The User creates an account by providing a valid email address. The User agrees to provide accurate, complete, and up-to-date information.
Account Security: The User is responsible for keeping their email address and the secret code sent confidential. Any unauthorized use must be reported immediately to Quztom.
Account Termination: Quztom reserves the right to suspend or delete any account in the event of non-compliance with these TCU, or for any other legitimate reason (such as fraudulent use of the service).

4. Acceptable Use

The User agrees to use the Services in accordance with applicable laws and these TCU. In particular, it is prohibited to:

Transmit illegal, defamatory, obscene, or otherwise offensive content.
Use the Services for fraudulent or malicious purposes.
Attempt to gain unauthorized access to Quztom’s systems or those of other Users.
Reproduce, distribute, or modify Quztom’s content without prior authorization.

Quztom reserves the right to take any appropriate measures (warning, suspension, account deletion) against a User who does not comply with these rules.

5. Intellectual Property

All content on the Quztom website (texts, images, logos, graphics, etc.) is protected by copyright and is the exclusive property of Quztom or its partners.
Any unauthorized reproduction, distribution, modification, or use of the website’s content is strictly prohibited.

6. User Content

Creation of Documents: The User can create technical documents by adding photos and descriptions of equipment or materials.
Requesting Copies: The User may request a copy of the documents sent by contacting Quztom’s support, subject to availability.
Rights to User Content: The User retains ownership of all content uploaded or published on Quztom. By using the Services, the User grants Quztom a non-exclusive, worldwide, and royalty-free license to use, reproduce, modify, adapt, and publish such content as part of providing the Services.

7. Advertisements

Quztom displays advertisements from third-party advertisers on its site. The content of these advertisements is the sole responsibility of the advertisers. Quztom cannot be held responsible for the practices or commercial offers presented in these ads.
The User understands that the presence of advertisements allows Quztom to offer its Services free of charge.

8. Liability

Quztom endeavors to provide reliable, high-quality Services. However, Quztom cannot guarantee the accuracy, reliability, or continuous availability of the Services.
Quztom cannot be held liable for direct or indirect damages resulting from the use of or inability to use the Services, including but not limited to the loss of data or profits.

9. Limitation of Liability

Under no circumstances shall Quztom be liable for any indirect, special, incidental, or punitive damages, even if Quztom has been advised of the possibility of such damages. Quztom’s total liability to the User shall in no event exceed the amount (if any) paid by the User for the Services in question.

10. Term and Termination

Term: The use of Quztom is provided for an indefinite period, subject to Quztom’s ability to maintain and continue the service.
Termination by the User: The User may cease using the Services at any time and request the deletion of their account by contacting support or through their personal account area.
Termination by Quztom: Quztom reserves the right to discontinue the Services, delete an account, or limit a User’s access in case of non-compliance with these TCU or for any other legitimate reason.

11. Personal Data

The User’s personal data is processed in accordance with Quztom’s Privacy Policy. By using the Services, the User consents to the processing of their data as described in that policy.

12. Changes to the TCU

Quztom reserves the right to modify these TCU at any time to adapt them to legislative, regulatory, technological, or organizational developments. The new TCU will apply as soon as they are published on the website. The User is encouraged to check the TCU regularly for any updates.

13. Disputes and Governing Law

These TCU are governed by French law. In the event of a dispute, the parties shall seek an amicable solution before submitting the matter to the competent courts. Failing an amicable resolution, the French courts shall have exclusive jurisdiction.
